Welcome toThe Body Fat Calculator END USER LICENSE AGREEMENT Copyright 2002-2003, TMM Medical Consultants This TMM Medical Consultants End User License Agreement [EULA] is a legal agreement between TMM Medical Consultants and you [either an individual or a single entity]. This agreement covers the computer software, documents, and associated media [to be referred to as the PRODUCT]. By installing, copying, or otherwise using the PRODUCT or any UPDATES [special conditions apply, see below], you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install the PRODUCT. GENERAL LICENSE You as an individual, or organization, are granted to install and use the PRODUCT on any number of computers within an organization providing : A) The terms of the license below are met. DISTRUBUTION The Body Fat Calculator as provided may be passed on freely provided the program and support materials are maintained intact with the above copyright and license aggreements. TERMS OF THE LICENSE 1. EULA grants you, as an individual, to use an unlimited number of copies of any documentary material, provided that use is for personal purposes only. You are prohibited from republishing or distributing, in any form, the documentation beyond the user's premises. 2. COPYRIGHT. All title and copyrights in and to the PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets," incorporated into the PRODUCT). The PRODUCT is protected by copyright laws and international treaty provisions. You must treat the PRODUCT like any other copyrighted material except that you may make copies of the PRODUCT solely for backup or archival purposes. 3. UPDATE LICENSE TERMS. All UPDATES shall be considered part of the PRODUCT and subject to the same terms that govern the PRODUCT. New additional license terms may accompany the UPDATES, which also must be agreed to before installation can take place. If you do not agree to the additional license terms accompanying UPDATES, do not install, copy, or otherwise use said UPDATES. DISCLAIMER OF WARRANTY No warranties. The PRODUCT is provided "as is" without warranty or guarantee of any kind. To the maximum extent permitted by applicable law, TMM Medical Consultants and its suppliers disclaim all warranties, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and any warranty against infringement, with regard to the PRODUCT. Customer remedies. TMM Medical Consultants entire liability or any exclusive remedy shall not exceed the price paid for the PRODUCT. Limitation of liability. To the maximum extent permitted by applicable law, in no event shall TMM Medical Consultants or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation damages for loss of business time, business profits, business information, or any other kind of loss) arising out of the use of, or inability to use the PRODUCT, or the failure to provide support services, even if TMM Medical Consultants, or one of its supplies has been advised of the possibility of such damages. TMM Medical Consultants's entire liability shall not exceed the price paid for the PRODUCT.
