Demicron - Electronic End-User Tryout License Agreement This is a legal agreement (this "Agreement") between you (either an individual or an entity) and Demicron AB, ("Demicron"). By using this tryout program (hereinafter the "SOFTWARE"), you are agreeing to become bound by the terms of this agreement. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT USE THIS SOFTWARE. PROMPTLY REMOVE IT FROM YOUR COMPUTER. 1. GRANT OF LICENSE. Demicron, as Licensor, grants to you, the Licensee, a non-exclusive right to evaluate this SOFTWARE in accordance with the terms contained in this license. This is not free software. You are hereby licensed to use this software for evaluation purposes only. You may install a copy of the SOFTWARE on a computer and freely move the SOFTWARE from one computer to another, provided that you are the only individual using the SOFTWARE. 2. OWNERSHIP OF SOFTWARE. Demicron retains the copyright, title and ownership of the SOFTWARE and the written materials regardless of the form or media in or on which the original and other copies may exist. 3. DISTRIBUTION Provided that you verify that you are distributing the Tryout Version (If you have the Tryout version, a window will be shown each time you start the Software informing that you are using the Tryout version) you are hereby licensed to make as many copies of the Tryout version of this SOFTWARE and documentation as you wish; give exact copies of the original Tryout version to anyone; and distribute the Tryout version of the SOFTWARE and documentation in its unmodified form via electronic means. There is no charge for any of the above. You are specifically prohibited from charging, or requesting donations, for any such copies, however made; and from distributing the SOFTWARE and/or documentation with other products (commercial or otherwise) without prior written permission. 4. TERM. This License will terminate automatically without notice from Demicron if you fail to comply with any provision of this License. Upon termination you shall destroy the written materials and all copies of the SOFTWARE, including modified copies, if any. 5. RESTRICTIONS You may not decompile, reverse engineer, disassemble, or otherwise reduce the SOFTWARE to a human-perceivable form. You may not modify, lend, rent, resell or create derivative works based upon the SOFTWARE or any part thereof. 6. THIS SOFTWARE AND ACCOMPANYING DOCUMENTATAION (INCLUDING INSTRUCTIONS FOR USE) ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, FURTHER, DEMICRON DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF USE, OF THE SOFTWARE OR DOCUMENTATION IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOUR. IF THE SOFTWARE OR WRITTEN MATERIALS ARE DEFECTIVE, YOU, AND NOT DEMICRON OR ITS DEALERS, DISTRIBUTORS, AGENTS, OR EMPLOYEES, ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. 7. THE ABOVE IS THE ONLY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, THAT IS MADE BY DEMICRON, ON THIS DEMICRON PRODUCT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY DEMICRON, ITS DEALERS, DISTRIBUTORS, AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE. YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. 8. NEITHER DEMICRON NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THIS PRODUCT SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OR INABILITY TO USE SUCH PRODUCT EVEN IF DEMICRON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 9.This License shall be governed and construed in accordance with the laws of Sweden and shall benefit Demicron, its successors and assigns. The SOFTWARE is owned by Demicron and are protected by Swedish copyright law and international treaty provisions.
