Project Consistency Manager 8.50 Evaluation License Agreement IMPORTANT READ CAREFULLY: By installing, copying or otherwise using the SOFTWARE, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the SOFTWARE. This is a legal agreement ("License Agreement") between you ("LICENSEE", either an individual or a single entity) and Zoltan Eter and Arpad Eter (hereinafter "AUTHOR"), for the software product Project Consistency Manager 8.50 Evaluation Edition ("SOFTWARE") of which Zoltan Eter and Arpad Eter are the copyright holders. The SOFTWARE is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE is licensed, not sold. Evaluation License Grant. This is not a free software. AUTHOR grants to LICENSEE a royalty-free, non-exclusive and non-transferable license to use the SOFTWARE for evaluation purposes for a period of 30 calendar days from the date of installation. If LICENSEE wishes to use the SOFTWARE after the 30-day evaluation period, the LICENSEE must purchase a single user license from the AUTHOR, or remove it from hard drive. Use of this SOFTWARE after the trial period of one month violates international Copyright law. Restrictions LICENSEE SHALL NOT: a) cause or permit reverse engineering, disassembly, decompilation or alteration of this SOFTWARE in any way; b) remove any product identification, copyright notices, or other registration reminders and restrictions from this SOFTWARE. c) sell, rent, lease or redistribute the SOFTWARE. Termination The license to use the SOFTWARE terminates automatically one month after start of usage. LICENSEE may terminate this Agreement at any time. AUTHOR may terminate this Agreement immediately if LICENSEE violates any provision of this Agreement. Upon termination of this Agreement for any reason, LICENSEE must destroy and remove from hard drives all copies of the SOFTWARE. Copyright/Ownership All rights, title, and copyrights in and to the SOFTWARE and any copies of the SOFTWARE are owned by the AUTHOR. The SOFTWARE is protected by copyright laws and international treaty provisions. LICENSEE must treat the SOFTWARE like any other copyrighted material. The SOFTWARE is licensed, not sold. The AUTHOR retains title and all ownership rights to the software. No Warranty, No Support LICENSEE understands that the SOFTWARE is provided solely for LICENSEE's internal use and evaluation purposes and AUTHOR will not provide support for the SOFTWARE. AUTHOR DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET LICENSEE'S REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE. AUTHOR EXPRESSLY DISCLAIMS ANY WARRANTY FOR THE SOFTWARE. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH LICENSEE. Limitation of Liability. In no event shall AUTHOR be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of, or inability to use this SOFTWARE, even if AUTHOR has been advised of the possibility of such damages.
