License Agreement By using any part of this software, you agree to the following terms and conditions. If you do not agree to these terms, you are not allowed to use any part of the software. 1. Grant of license Pavel Werl, based at Fryčajova 290/156, Brno, 614 00, Czech Republic (referred to as 'licensor' hereinafter) grants you a worldwide, non-exclusive, non-transferable, perpetual license to use the enclosed copy of software in accordance with the terms set forth in this license agreement. 2. Ownership The software is owned by the licensor, and you have no ownership rights in the software. 3. Copyright The software is protected by copyright laws and international treaties. All rights not granted to you herein are expressly reserved by the licensor. 4. Restrictions You may not sell, resell, charge for, sub-license, rent, lease, loan, vary, modify, alter, translate, repackage, publish, display, disclose, distribute, or create derivative works based on the software or any part thereof without prior written consent of the licensor. Disclaimer of liability In no event shall the licensor be liable to you or any third party on any legal theory for any damages, claims or costs whatsoever (whether in contract, strict liability, tort, negligence or otherwise), arising in any way out of this license or the use of the software or the inability to use the software (including, but not limited to, loss of data, business, or profits; business interruption; any direct, indirect, special, incidental, consequential, punitive or exemplary damages; or otherwise), even if the licensor has been advised of the possibility of such damages. Upon termination of this license agreement, you must immediately cease all further use of the software and irreversibly destroy all copies of the software in your possession or under your control. Sections 2, 3, 4, 5, 6, 7, 8, 10, and 11 will survive any termination of this license howsoever caused. 11. Jurisdiction This license agreement and any disputes or claims arising out of or in connection with it or its subject matter or its formation (including non-contractual disputes or claims) shall be construed, interpreted and governed by the laws of the Czech Republic without regard to conflicts of law provisions thereof. The exclusive forum for any disputes relating to this license agreement shall be an appropriate court sitting in the Czech Republic. 12. General This license agreement constitutes the entire agreement between the parties hereto. If any provision of this license is invalid or unenforceable under applicable law, the remainder of this license agreement shall be interpreted so as to reasonably effect the intention of the parties.
