MACROSPARK SOLUTIONS SOFTWARE LICENSE AGREEMENT DEFINITIONS "We", "Our" or "Us" means Macrospark Solutions. "You" or "Your" means the end user of the Software, whether an individual or an entity. "Software" means the software product You have purchased a license for or obtained for evaluation, including the program, documentation and associated media. "Trial Copy" means a copy of the Software distributed by Us for evaluation purposes and which is described as a trial or unregistered copy in the program's messages or About box. "Key" refers to a registration code that is provided by Us upon purchasing a license to use the Software. IMPORTANT NOTICE This is a legal agreement between You and Us. Your use of the Software is conditional upon compliance with the terms of this agreement. If You do not agree to the terms of this agreement, do not install or use the Software. COPYRIGHT The Software is protected by copyright law and international treaties. We retain all intellectual property rights in relation to the Software. You may not reverse engineer, de-compile or disassemble the Software. GRANT OF LICENSE You may use a Trial Copy of the Software for evaluation, in order to determine whether the Software meets Your requirements before purchasing. If You purchase a license to use the Software, no refund will be payable if You decide subsequently that You no longer want the Software. You may freely distribute copies of the Trial Copy of the Software, as long as You do not charge for this without direct authorization from Us. You may not change the original distribution files in any way. You must not attempt to use the Trial Copy after any trial period has expired or attempt to overcome any restrictions that have been applied to the Trial Copy. After purchasing a license to use the Software, You will be provided with a Key. If You have purchased only a single license, You may install a Key simultaneously on up to two computers, provided that You are the primary user of both computers and the Software will not be in use on both computers at the same time. If installation onto a portable device is explicitly provided as an option in the distribution, You may also install a Key on one such portable device for Your personal use only. A Key may be installed only by using the functionality provided for that purpose in the Software. If You want to use the Software on multiple computers or portable devices or on a network, a separate license must be purchased for each computer or portable device that will use the Software. You must take adequate steps to keep Your Key private and prevent disclosure of Your Key to anyone else. You must not publish or distribute a Key by any means without direct authorization from Us. If You do, Your license to use the Software is automatically terminated, You must remove the Software from Your computer(s) and other devices, and You may be liable for legal damages. The Software is licensed, not sold. This license is not transferable to any other system, or to another organization or individual. DISCLAIMER We do not warrant that the Software is error free. We disclaim all other warranties with respect to the Software, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. LIMITATION OF LIABILITY In no event shall We be liable for any consequential, incidental or other damages whatsoever arising out of the delivery or use of the Software or Your relationship with Us, even if We have been advised of the possibility of such damages. In no event will Our liability for any claim exceed the license fee paid by You. SEVERABILITY In the event of invalidity of any provision of this license, the parties agree that such invalidity shall not affect the validity of the remaining portions of this license.
