MagneticOne osCommerce Manager End User License Agreement (EULA) THIS IS A LEGAL AGREEMENT between you, the end user of MagneticOne osCommerce Manager brand software, and MagneticOne, a Ukrainian privately held company (“MagneticOne”). Use of the software you are about to download or install indicates your acceptance of these terms. You also agree to accept these terms by so indicating at the appropriate screen, prior to the download or installation process. As used in this Agreement, the capitalized term Software means the MagneticOne osCommerce Manager software (either the freeware or commercial versions) together with any and all enhancements, upgrades, and updates that may be provided to you in the future by MagneticOne. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU SHOULD SO INDICATE AT THE APPROPRIATE SCREEN AND PROMPTLY DISCONTINUE THE INSTALLATION AND DOWNLOAD PROCESS. NO WARRANTY MAGNETICONE OSCOMMERCE MANAGER IS DISTRIBUTED AS IS AND WITHOUT ANY WARRANTY AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTIES EITHER EXPRESSED OR IMPLIED. Distribution of the Evaluation/Demo Version You may copy the Evaluation Version of this software and documentation as you wish, and give exact copies of the original Evaluation Version to anyone, and distribute the Evaluation Version of the software and documentation in its unmodified form via electronic means. But you should not charge or request donations for any such copies however made, or from distributing the software and/or documentation with other products without the authors written permission. If you have registered the software, you must not distribute your confidential license key. Registered Version One registered copy of MagneticOne osCommerce Manager may either be used by a single person who uses the software personally on one computer, or installed on a single workstation used non-simultaneously by multiple people. You may access the registered version of MagneticOne osCommerce Manager through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network. After registering, you should have received a license key/full version which is necessary to disable all limitations of evaluation version. This code must be kept in the strictest confidence and must not be given or revealed to anyone but the registered owner. Failure to abide by this provision may result in severe legal penalties. Additional Licenses Additional licenses can be obtained at discount rates, according to current rates stated on official MagneticOne osCommerce Manager website. Primary full license is required before getting additional licenses. Additional licenses can be used only within same organization/family. Product Updates MagneticOne osCommerce Manager is a software product, it is constantly updated by product the developer - MagneticOne. MagneticOne will provide you with free upgrades for a period that begins on the purchase date and ends 365 days later. Such upgrades will include any upgrades for MagneticOne osCommerce Manager that are released by MagneticOne for general distribution to MagneticOne osCommerce Manager licensees during the one year period for which you are entitled to receive free upgrades. MagneticOne has no obligation to provide you with any upgrades that are not released for general distribution to MagneticOne’s other licensees. Nothing in this Agreement shall be construed to obligate MagneticOne to provide upgrades to you under any circumstances. Support MagneticOne will provide you with support services related to MagneticOne osCommerce Manager (“Support Services”) for a period that begins on the purchase date and ends 365 days later. The nature, scope and extent of Support Services shall be as set forth in MagneticOne’s policies and programs described in any user manuals, in “online” documentation, and/or other MagneticOne provided materials and are subject to change in MagneticOne’s sole discretion. Software Suggestions MagneticOne welcomes suggestions for enhancing the Software and any accompanying documentation that may result in computer programs, reports, presentations, documents, ideas or inventions relating or useful to MagneticOne’s business. You acknowledge that all title, ownership rights, and intellectual property rights concerning such suggestions shall become the exclusive property of MagneticOne and may be used for its business purposes in its sole discretion without any payment or accounting to you.
