Software License Agreement XcessColorPicker.Net (English) This Software License Agreement ("Agreement") is a legal Agreement for the conditional use of the software provided herein ("Software") between you and the owner of XcessColorPicker.Net ("Xcess Company"). By downloading, copying or otherwise using the Program, you agree to be bound by the terms of the foregoing license. XcessColorPicker license agreement concerns for use of this software By One Developper or one Single Company. 0. Copyright The Program and documentation are owned by Xcess Company and its suppliers and are protected by copyright laws. Therefore, you must treat the Program and documentation like any other copyrighted material except as expressly permitted in this Agreement. All users and parties accessing this web site are hereby notified that any and all software that is made available to download from through this web site ("Software") is the copyrighted work of Xcess Company. 1. License Grant Under the terms and conditions of this Agreement you may: You may not rent or lease the Program. You may not reverse engineer, decompile or disassemble the Program. If any provision of this agreement is unlawful, void, or for any reason unenforceable, it shall be deemed severable from, and shall in no way affect the validity or enforceability of the remaining provisions of this agreement. This agreement shall be governed by Tunisian law and all recognized international treaties or conventions. You acknowledge that you have read and that you fully understand every provision of this agreement. 4. Passing of the Risk The risk will pass to the Customer once Xcess Company has handed over the goods to the forwarding agent. 7. Place of Jurisdiction The place of performance and place of jurisdiction will be where Xcess Company is located, if the Customer is a businessman or a corporation under public law. This legal relation between Xcess Company and Customers as well as the respective Terms and Conditions shall be governed solely and exclusively by Tunisian Law. 8. Warranty XCESS COMPANY COMPONENT IS PROVIDED AS-IS WITHOUT WARRANTY OF ANY KIND. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU. XCESS COMPANY DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF, RESULTS OF, MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OF THE PRODUCT. SHOULD THE PRODUCT PROVE DEFECTIVE, YOU (AND NOT Xcess Company) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. FURTHER XCESS COMPANY DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF, OR THE RESULTS OF THE USE OF THE PRODUCT IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR OTHERWISE; AND YOU RELY ON THE PRODUCT AND RESULTS SOLELY AT YOUR OWN RISK.
