Handy Label Maker Software License and Use Agreement END-USER LICENSE AGREEMENT FOR Handy Label Maker Handy Label Maker is a product of Track Your Trades IMPORTANT: YOU SHOULD READ THE FOLLOWING TERMS AND CONDITIONS OF THIS SOFTWARE LICENSE AGREEMENT ("LICENSE") CAREFULLY BEFORE YOU INSTALL THE PROGRAM. BY INSTALLING THE PROGRAM, YOU INDICATE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND ACCEPT THE TERMS AND CONDITIONS HEREIN. YOU FURTHER ACKNOWLEDGE THAT THIS LICENSE CONSTITUTES A LEGALLY BINDING AGREEMENT BETWEEN YOU AND Handy Label Maker, LLC. AND SUPERCEDES ANY PRIOR AGREEMENT OR PROPOSAL, ORAL OR WRITTEN. Track Your Trades ("TYT") company provides the computer software program Handy Label Maker (Software) contained herein and any modifications, updates, revisions, or enhancements received by you from TYT or its dealers, and licenses its use within the terms stated below: You are granted a nontransferable license to use the Software under the terms stated in this Agreement for personal use in your home, business or profession. "Personal use" means use exclusively by you, the Registered User, and does not include use by your business associates, partners, employees or co-workers. Each user of the Software must purchase his or her own individual license. If you have licensed a single user version of the Software, you have the right to use the single user version on a maximum of two personal computers (laptops/desktops) for your personal use only. Unless you have licensed a network version of the Software, you may not use the Software in a multiple-user access arrangement simultaneously in a network. You may not make copies, translations, or modifications of, or to, the Software. You may copy the Software into machine-readable form for backup purposes in support of your use of the Software. You may not assign, sell, distribute, lease, rent, sub-license or transfer the Software or this license, or disclose the Software to any other person. This software is licensed with the understanding that TYT is not engaged in providing professional, legal, business, investment, financial, or tax advice. This license terminates if you fail to comply with any provision of the Agreement. You agree upon termination to destroy the Software, together with all copies, modifications and merged portions in any form, including any copy in your computer memory or on any electronic media. LIMITED WARRANTY: TYT warrants that the Software and media substantially conforms to the specifications contained in the packaging and promotional materials for a period of ninety (90) days from delivery as evidenced by your receipt, provided that the Software is used on the computer operating system for which it was designed. TYT's sole obligation and liability for breach of the foregoing warranties shall be to replace or correct the Software so that it substantially conforms to the specifications or to replace the defective media, as the case may be. Any modification of the Software by anyone other than TYT voids the foregoing warranty. NO OTHER WARRANTIES ARE EXPRESSED AND NONE SHALL BE IMPLIED: TYT specifically excludes any implied warranties of merchantability and fitness for a particular purpose. Some states do not allow the exclusion of implied warranties so the foregoing may not apply to you. LIMITATION OF LIABILITY: In no event shall TYT's liability for damages hereunder for any cause whatsoever exceed the amount paid by you for licensed use of the Software. In no event will TYT be liable for any lost profits, tax penalties, or other incidental or consequential damages arising out of the use or inability to use the Software even if TYT has been advised of the possibility of such damages.
