END-USER LICENSE AGREEMENT IMPORTANT - READ CAREFULLY: This Gaia Dream Creation End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and Gaia Dream Creation Inc. for GAIA PC JIGSAW PUZZLE 2 (Trial version) (“Software”) identified in this installation software, which includes computer software and may include associated media, printed materials, and “online” or electronic documentation. The Software also includes any updates and supplements to the original Software provided to you by Gaia Dream Creation. Any software provided along with the Software that is associated with a separate end-user license agreement is licensed to you under the terms of that license agreement. By installing, copying, downloading, accessing or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software. The EULA may be updated later to reflect new situations. USE OF SOFTWARE The Software is made available to you for your personal, non-commercial use only. You may not use the Gaia Dream Creation Software in any manner that could damage, disable or impair Gaia Dream Creation's products and/or services. PRIVACY POLICY As a condition of downloading and using the Software, you agree to the terms of Gaia Dream Creation Privacy Policy at http://www.gaiadreamcreation.com/privacy/, which may be updated from time to time and without notice. LICENSE This license grants you the right to install the Software as a shareware on your computer to evaluate the features, good execution and use of the Software. The license granted to you by Gaia Dream Creation is not transferable. You may not rent or lease the Software or any right or license granted under the EULA. PROPRIETARY RIGHTS You acknowledge that (a) the Software contains proprietary and confidential information that is protected by applicable intellectual property and other laws, and (b) Gaia Dream Creation and/or Third Parties own all right, title and interest in the Software and software provided in conjunction with the Software, including without limitation all Intellectual Property Rights. 'Intellectual Property Rights' means any and all rights existing from time to time under patent law, copyright law, trade secret law, trademark law, and any and all other proprietary rights, and any and all applications, renewals, extensions and restorations thereof, now or hereafter in force and effect worldwide. You agree that you will not, and will not allow any third party to, (i) copy, sell, license, distribute, transfer, modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the Software, (ii) take any action to circumvent or defeat the security or content usage rules provided, deployed or enforced by any functionality (including without limitation digital rights management functionality) contained in the Software, (iii) use the Software to access, copy, transfer or retransmit content in violation of any law or third party rights, or (iv) remove, obscure, or alter Gaia Dream Creation's or any Third Party's copyright notices, trademarks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through the Software. DISTRIBUTION. This Trial Version of the Software may be copied as you wish; give exact copies of the original installation software to anyone; and distribute the installation software in its unmodified form via electronic means (Internet, BBS's, Shareware distribution libraries, CD-ROMs, etc.). You may charge a distribution fee for the package, but you must not represent in any way that you are selling the Software itself. Individual components inside the installation software could not be distributed independently from the installation software. ACTIVATION The full version of the Software requires an Internet connection at the moment of the installation. AUTOMATIC UPDATES The Software may communicate with Gaia Dream Creation servers via the Internet from time to time to check for available updates of the Software, such as new versions. The Software will notice that a new version is available, however it will not automatically install it. By installing the Software, you agree to automatically request and receive update notices as mentioned above. Update information files could be downloaded to your computer into the data folder or temporary files folder. Also, the installation program may update any components of DirectX if required. INDEMNITY You agree to hold harmless and indemnify Gaia Dream Creation and its subsidiaries, affiliates, officers, agents, and employees, and the Third Parties and their subsidiaries, affiliates, officers, agents, and employees from and against any claim, suit or action arising from or in any way related to your use of the Software or your violation of these Terms and Conditions, including any liability or expense arising from all claims, losses, damages, suits, judgments, litigation costs and attorneys' fees, of every kind and nature. The Software has been developed and tested properly not to cause any damages to individuals, software, hardware or any other entities that could be involved from the use of the Software. You agree to assume certain risks with their consequences from the use of the Software and you agree to recognize that Gaia Dream Creation cannot guarantee the perfect use of the Software without any problems related to the computer settings, software, hardware, satisfaction or comprehension of the functionality of the Software. LIMITATION OF LIABILITY You understand and agree that neither Gaia Dream Creation nor the third parties shall be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Gaia Dream Creation or the third parties have been advised of the possibility of such damages) resulting from: (i) the use or the inability to use the Software; (ii) the inability to use the Software to access content or data; (iii) the cost of procurement of substitute goods or services; (iv) unauthorized access to or alteration of your transmissions or data; or (v) any other matter relating to the Software. TERMINATION You may terminate this EULA at any time by uninstalling the Software and permanently deleting the installation program. Uninstalling the Software and permanently deleting the installation program will automatically terminate the EULA as long as there are no other actions done in relation to the Software. Gaia Dream Creation may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the Software. MISCELLANEOUS (i) Gaia Dream Creation is fully engaged to support its products, however Gaia Dream Creation does not give any warranties that version updates will be available to fix any bugs. (ii) After uninstalling the Software, some files may be left on your computer's hard disk.
