END-USER LICENSE AGREEMENT IMPORTANT - READ CAREFULLY: This license agreement is a legal agreement between you (either an individual or a single entity) and ExtraLabs Software ("Manufacturer”) for this product (Feed Editor), including the software, possible media, and documentation (printed or electronic) ("Product"). By installing, copying, or otherwise using the Product, you agree to be bound by the terms of this license agreement. If you do not agree to the terms of this license agreement, do not install or use the Product. The Product is protected by copyright laws as well as other intellectual property laws and treaties. The Product is licensed, not sold. 1. PRERELEASE CODE. 1.1 This version of the product is a prerelease version that is not at the level of performance and compatibility of the final product offering. The prerelease version may not operate correctly and may be substantially modified prior to first commercial shipment. The license for the use of the prerelease version expires when the final, commercial product version becomed available. 1.2 This version and this license is time-limited and expires after a date as mentioned in the accompanying documentation and the "About Feed Editor" window (in the Help menu); after that day, you may no longer use the Product, even if you received it after that day (e.g. from an old download source). Of course you are not allowed to take any measures (e.g. changing your system's date) to circumvent this expiration. The manufacturer will try and make available a new prerelease version or the final commercial version in time before the expiration date. 2. USAGE, WARRANTY, LIABILITY etc. 2.1 In case the media used to deliver the Product is damaged, you will receive a free replacement (within a sensible length of time). 2.2 The faultless working of the Product can, especially due to so many possible system configurations, not be guaranteed. 2.3 LIMITED WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MANUFACTURER AND DISTRIBUTOR DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE PRODUCT. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE MANUFACTURER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF THE MANUFACTURER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 2.4 You may distribute this test version as you like - to friends, to a program collection (online or CD etc.) - as long as you include all of and only the original, unmodified files, and free of charge (except maybe minimal copy fees). 3. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS. 3.1 You may not reverse engineer, decompile, or disassemble the Product, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. 3.2 Termination: Without prejudice to any other rights, the manufacturer may terminate this license agreement if you fail to comply with the terms and conditions of it. In such event, you must destroy all copies of the Product and all of its component parts. 4. MISCELLANEOUS. 4.1 All title and copyrights in and to the Product and any copies of the Product are owned by the manufacturer or its suppliers. 4.2 All trademarks or registered trademarks used in this Product belong to their respective owners. 4.3 Should parts of this license agreement be invalid under valid jurisdiction, the other parts are not influenced by this.
