IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, YOU ARE NOT AUTHORIZED TO DOWNLOAD OR USE THIS SOFTWARE. 1. License The software key and other information accompanying this License (the "INZOMIA Software") is licensed to Licensee by Fredrik Lnn, Stalgatan 28b, SE-756 48 Uppsala, Sweden ("INZOMIA"). INZOMIA and Licensee agree that the following terms and conditions shall govern the use of INZOMIA Software. 2. Permitted Uses and Restrictions, Proprietary Rights This License allows Licensee, subject to the rightful payment of the applicable license fee and the requirements in this License, to install and use the INZOMIA Software, in object code form only, on one (1) single cpu at the time. Licensee may make one copy of the INZOMIA Software in machine-readable form for backup purposes only. The backup copy must include all copyright information contained on the original. If Licensee desires to rent, lease or otherwise distribute the INZOMIA Software to third parties, Licensee must first apply for an additional Distribution License allowing such use from INZOMIA, and pay the corresponding license fees. Except as permitted by applicable law and this License, Licensee may not copy, decompile, reverse engineer, disassemble, modify, rent, lease, loan, distribute, create derivative works from the INZOMIA Software, or transmit the INZOMIA Software over a network. Support INZOMIA will use reasonable efforts to provide support of the INZOMIA Software through the INZOMIA web site. The web site will contain user manual for the INZOMIA Software, a QA regarding the INZOMIA Software updated on a continuing basis, software releases or corrections made generally available by INZOMIA, and general product information. Any upgrades or updates of the INZOMIA Software shall be deemed INZOMIA Software and shall be governed by this License. 4. Disclaimer of Warranty Licensee expressly acknowledges and agrees that use of the INZOMIA Software is at Licensee's sole risk. The INZOMIA Software is provided "AS IS" and without warranty of any kind and INZOMIA expressly disclaim all warranties and/or conditions, express or implied, including, but not limited to, the implied warranties and/or conditions of merchantability or satisfactory quality and fitness for a particular purpose. INZOMIA does not warrantthat the functions contained in INZOMIA Software will meet Licensee's requirements, or that the operation of INZOMIA Software will be uninterrupted or error-free, or that defects in INZOMIA Software will be corrected. Furthermore, INZOMIA does not warrant or make any representations regarding the use or the results of the use of the INZOMIA Software or in terms of their correctness, accuracy, reliability, non-infringement or otherwise. INZOMIA neither assumes nor authorizes any other person to assume for it any other liability in connection with the licensing, installation or use of INZOMIA Software. Should INZOMIA Software prove defective, Licensee and not INZOMIA assume the entire cost of all necessary servicing, support or correction. INZOMIA neither assumes nor authorizes any other person to assume for it any other liability in connection with the licensing, installation, maintenance or use of INZOMIA Software. The terms of this disclaimer do not affect or prejudice the statutoryrights of a consumer acquiring INZOMIA Software otherwise than in the course of a business, neither does it limit or exclude any liability for death or personal injury caused by INZOMIA's negligence. 5. Limitation of Liability Under no circumstances, including negligence, shall INZOMIA be liable for any incidental, special, indirect or consequential damages arising out of or relating to this License. In no event shall INZOMIA's total liability for all damages pursuant to this License exceed the amount paid for this License to INZOMIA Software. 6. Term and Termination Provided Licensee is not in breach of any of its obligations pursuant to this License, this License will be effective for an indefinite duration. Licensee's rights under this License will terminate automatically, without notice from INZOMIA, if Licensee fails to comply with any term(s) of this License. Licensee may also terminate this License at any time. Upon termination, Licensee must destroy all copies of the INZOMIA Software and delete all references and code created by the use of the INZOMIA Software. 7. Disputes and Controlling Law This License shall be governed by the laws of Sweden, excluding its conflict of law provisions. Any dispute, controversy or claim arising out of or in connection with this License, or the breach, termination or invalidity thereof, shall be settled by Swedish courts. 8. Complete Agreement This License constitutes the entire agreement between the parties with respect to the use of the INZOMIA Software and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by INZOMIA.
