By using the eRA Pre-Auction Decision Analysis Tool ("Tool"), you agree that (1) you are using the Tool for your own, personal, not-for-profit purposes; (2) you will not modify, adapt or translate the Tool; (3) you will not reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Tool except to the extent you may be expressly permitted under applicable law; (4) you will not rent, lease, sublicense or assign your rights in the Tool; (5) you are using the Tool voluntarily and entirely at your own risk; (6) it is your sole responsibility to evaluate the accuracy, completeness, and usefullness of the Tool; (7) the Tool is provided "as is" without warranties of any kind, either expressed or implied; (8) under no circumstances shall the author, his licensees, or his assigns be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from your use, non-use or reliance upon the Tool, or that result from mistakes, omissions, interruptions or deletions of files, errors, or defects in the tool.
