Enigma Recovery Software License Agreement 1. THIS AGREEMENT This license agreement is a legal agreement between you the end user (as an individual) and Enigma Recovery (herein referred to as the authors). Please read this document carefully before installing Enigma Recovery Software (herein referred to as SOFTWARE). By installing or using this software you indicate your full and unconditional acceptance of these terms and conditions. If you do not agree with the terms of this agreement do not install or use this software. The authors reserve the right to modify all or part of this Agreement at any time, effective immediately upon notice published on www.enigma-recovery.com. By continuing to use the product you indicate your acceptance of these terms and conditions including any modifications made by the authors as permitted above. If the terms and conditions of this agreement are no longer acceptable to you, you must cease all use of the software and uninstall it. 2. GRANT OF LICENSE You are entitled to download one free trial version of this software for use during the specified limited trial period. The limited features and conditions of the trial version may be subject to change by the authors without prior notice. At the end of this trial period, you will be required to either uninstall the software or purchase an activation code. Once your payment has been processed, you will have unlimited access to the full version of the software. By purchasing and registering a full version of this software you declare it to be fit for your purposes. 3. LICENSE RESTRICTIONS The full purchased version of the software may be used by a single person for personal use on a single computer. This software can be used in a network, provided that each individual workstation or computer has obtained individual licenses for installation and usage. You may not, and you may not permit others to: a. Alter, merge, modify or adapt the software. b. Decompile, reverse engineer or dissemble the software. c. Rent, lease or sublicense the software for a fee. d. Place the software onto a server so that it is accessible via a public network. e. Distribute or publicise activation codes, algorithms or information used by this software without obtaining permission from the authors. f. Distribute the software on CD-ROM, disk or other physical media for a fee without the permission of the authors. 4. ACCEPTABLE USE POLICY This software may be used for lawful purposes only. It is to be used by you for the backup, retrieval and recovery of lawfully owned copyrighted and non-copyrighted material. You are not allowed to use this software to transfer any copyrighted material which you do not lawfully own in a way that is not acceptable to the copyright owner. This software may only be used on devices personally owned by you. This software is not to be used on devices which are not owned by you and which you do not have prior permission to access. 5. REFUNDS The authors liability will not exceed the purchase price of the software. Due to the nature of the software, we do not offer refunds if after purchasing an activation code, you change your mind or find that the software is not suitable for your needs. It is your responsibility to use the trial period to evaluate and ensure that the software is suitable for your needs. We may only offer a refund in circumstances where you find fault in the software. If this is the case please email [email protected] with your request within 30 days of purchasing the software. Each case will be evaluated on an individual basis. The authors retain the right to withhold a refund at their discretion. If a refund is received, you must uninstall the software from your computer. You may not reinstall the software without purchasing another activation code. This does not affect your statutory rights. 6. COPYRIGHT This software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The uses of imagery, screenshots or logos of the software are strictly prohibited without prior written approval from the authors. All third-party trademarks are the property of the respective owners. 7. LIMITED WARRANTY This software and accompanying written materials are provided as-is without warranties, either express or implied, of any kind. The entire risk arising out of the use or performance of the product and accompanying documentation remains with the recipient. Whilst we take reasonable care to ensure the proper operation of this software, neither the authors nor anyone else who has been involved in the creation, production or delivery of the software will be held liable for any direct, indirect, consequential or incidental damages arising out of the use of or inability to use the software even if the authors have been advised of the possibility of such damages this includes but is not limited to the loss of data or information or damage to any equipment. This limitation of liability will apply whether the damages arise from use or misuse of and reliance on the software, from inability to use the software, or from the interruption, suspension or termination of the software. We cannot guarantee that our software will always be able to recover data from backup files. Specifically, encrypted backups are not currently supported by the software. You should maintain your own independent copy of relevant backup files or recovered data. 8. PRIVACY If you purchase an activation code for the software, your email address may be kept by the authors. This email will be used to communicate with you about updates to your software or for software usage support (unless another email address is provided). From time to time we may send you news and updates about other products from Enigma Recovery. If you do not wish to be contacted for this purpose please opt out of this option on the software registration page or email [email protected]. Your email address and personal details provided by you will not be sold or passed on to any third party. 9. TERMINATION If you fail to comply with any of the above stated terms and conditions, the license will terminate automatically and your software will be unregistered. In this circumstance we will inform you by email to the email address we have on record for you. At this point you must uninstall and delete any copies of the software and accompanying documentation in your possession. If you have purchased the full version of the software and we terminate this agreement for a material breach you are not entitled to any refund of the original purchase price for the software. You may terminate this agreement at any time without prior warning and without notifying Enigma Recovery. If you choose to do so, you must uninstall and delete any copies of the software and accompanying documentation in your possession.
