All Rights Reserved IMPORTANT: Read this carefully before using your copy of AMPHIOTIK ENHANCER PR (PRofessional edition) software. ATTENTION: This HOLISTIKS End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and HOLISTIKS, for the HOLISTIKS software accompanying this EULA, which includes computer software and may include associated media, printed materials, and "on-line" or electronic documentation ("SOFTWARE PRODUCT" or "SOFTWARE"). It defines what you may do with the product and contains limitations on warranties and/or remedies. This license is granted by HOLISTIKS for all the licenses fro the products purchased either directly or through any authorized agent of the company. By exercising your rights to make and use copies of the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, you may not use the SOFTWARE PRODUCT. 1. SOFTWARE PRODUCT LICENSE The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold. 2. GRANT OF LICENSE This EULA grants you the following rights: 2.1 Installation and Use. You may install and use up to three copies of the SOFTWARE PRODUCT on up to three computers, provided you are the only user. Optionally you may store or install the SOFTWARE PRODUCT on a storage device, such as a network server, to run the SOFTWARE PRODUCT on your computer or your other computers; however the same license may not be shared or used concurrently by different users. Sufficient licenses must be acquired for each shared or concurrently used SOFTWARE PRODUCT. 2.2 Reproduction. You may not reproduce the SOFTWARE PRODUCT. 2.4 Distribution. You may not distribute the SOFTWARE PRODUCT except to make backup copies, or to install as provided for above. 2.3 Commercial usage. The license of this SOFTWARE PRODUCT grants you for commercial usage. You may use this SOFTWARE PRODUCT in any commercial form including but not limited to broadcasting (radio, TV, internet, etc.), bars, clubs, restaurants, audio CDs whose tracks have been produced with the SOFTWARE PRODUCT, etc. 3. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS 3.1 Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law not withstanding this limitation. 3.2 Software Transfer. You may permanently transfer all of your rights under this EULA, provided you retain no copies, you transfer all of the SOFTWARE PRODUCT, and the recipient agrees to the terms of this EULA. 3.3 Termination. Without prejudice to any other rights, HOLISTIKS may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts. 4. COPYRIGHT All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, text, and "applets" incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by HOLISTIKS or its suppliers. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material. 5. LIMITED WARRANTY NO WARRANTIES. HOLISTIKS EXPRESSLY DISCLAIMS ANY WARRANTY FOR THE SOFTWARE PRODUCT. THE SOFTWARE PRODUCT AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
